Judge Myong J. Joun: ELECTRONIC ORDER entered. After careful review of the DPPs and Retailers Motions for Judgment, [Doc. No. 932; Doc. No. 936], the Motions are DENIED as moot, and the Court sets the following post-trial schedule:
1. Post-trial EPP Damages Proceedings: August October 2026.
2. The Court will resolve EPPs Damages claims, Takedas pending Motion to Decertify the DPP class, Doc. No. 938 , and determine whether a hearing is warranted regarding Takedas objections to DPPs plan of allocation, Doc. No. 999 , or otherwise resolve those objections.
3. Within two weeks of the Courts resolution of EPPs Damages claims, Takeda may file a Motion to Decertify the EPP class. EPPs shall file any opposition within two weeks thereafter, and Takeda may file a reply within one week of the filing of the opposition.
4. Following resolution of Takedas Motion to Decertify the EPP class, the Court will enter Judgment in all three cases.
5. Following the Courts resolution of Takedas Motion to Decertify the EPP class, Takeda may file a timely Rule 50/59 Motions as to all Plaintiffs. Plaintiffs shall file any opposition within 30 days, and Takeda shall file a reply within two weeks thereafter.
6. Following resolution of the Rule 50/59 Motions, the parties may file any notices of appeal.
