Order ~Util - Terminate Deadlines and Hearings
ORDER by Magistrate Judge Susan Prose on 12/19/25. On November 4, 2025, the court granted the motion of Haynes and Boone, LLP to withdraw as counsel for Plaintiff Etana Custody Limited and Third-Party Defendant Etana Holdings, Inc., and ordered substitute counsel to enter an appearance by November 25, 2025. ECF No. 54. As of the date of this Order, no substitute counsel has entered an appearance on behalf of Etana Custody Limited or Etana Holdings, Inc. "[A] corporation or other business entity can only appear in court through an attorney and not through a non-attorney corporate officer appearing pro se." Harrison v. Wahatoyas, L.L.C., 253 F.3d 552, 556 (10th Cir. 2001). Accordingly, on or before January 3, 2026, Etana Custody Limited and Etana Holdings, Inc. shall cause counsel admitted to practice before this court to enter an appearance. Failure to comply with this Order may result in the undersigned recommending dispositive sanctions to the district judge, including dismissal of the case. In light of the issues addressed herein, the Final Pretrial Conference set for January 20, 2026 is VACATED, and the deadline to file the proposed Final Pretrial Order and associated documents (January 13, 2026) is VACATED. The Final Pretrial conference will be reset, if necessary, if Plaintiff and Third-Party Defendant secure counsel. As a one-time courtesy, the Clerk of Court is directed to send, by U.S. mail and email, a copy of this Order to Etana Custody Limited and Etana Holdings, Inc. at the addresses noted in the docket (as provided in the certificates of service at ECF No. 51 and ECF No. 59).
