TEXT ORDER: Before the Court is Plaintiff Michael E. Nelsons emergency motion for a temporary restraining order and preliminary injunction, ECF No. 2 . "Injunctive relief is an 'extraordinary and drastic remedy that is never awarded as of right.'" Calvary Chapel Belfast v. University of Maine System, 180 F.4th 13, 24 (1st Cir. 2026) (quoting US Ghost Adventures, LLC v. Miss Lizzie's Coffee LLC, 121 F.4th 339, 347 (1st Cir. 2024)). After reviewing the First Amended Complaint and the arguments in support of and in opposition to the emergency injunctive relief requested, the Court concludes that, on the record before it, Plaintiff has not established a likelihood of success on the merits of his claims and the Court will not enjoin Defendants at this time. See New Comm Wireless Servs. Inc. v. SprintCom, Inc., 287 F.3d 1, 9 (1st Cir. 2002) (discussing that a motion for injunctive relief can rise or fall on this likelihood of success on the merits factor). The motion is DENIED.
