The Court held a pre-motion conference regarding Safety's anticipated motion for attorney fees and costs. Safety shall serve, but not file, its motion by June 10, 2024. Cincinnati shall serve, but not file, its response by June 24, 2024. Safety shall serve its reply on July 3, 2024, and on that date, the parties shall file their motion papers on ECF in logical order and deliver two courtesy copies of their motion papers (including attachments) to Chambers by either FedEx or messenger.
Safety shall include all necessary documentation supporting its requests, along with summaries and detailed calculations permitting the Court to ascertain a precise award. Safety's memorandum of law in support of its motion shall include citations to appropriate legal authorities with a detailed explanation of how it arrived at its requested amounts. Cincinnati's opposition must explain the precise basis for any objections to Safety's requests, including citations to legal authorities and attaching any necessary additional documentation. Cincinnati also must explain how its objections are consistent with the Court's 88 summary judgment order. Should the parties need to file any attachments under seal, they shall do so in accordance with the Court's procedures (https://img.nyed.uscourts.gov/files/forms/EfilingSealedCV.pdf).
LM may make its request for severance by letter by May 29, 2024. Any other party may respond by June 7, 2024. (Court Reporter Michele Lucchese.) (MJF)
