Optima's claim for promissory estoppel (Count II) is DISMISSED with prejudice. Optima's breach-of-contract claim and Zeochem's breach-of-contract counterclaim remain. This matter is REFERRED to Magistrate Judge Colin H. Lindsay for a status conference to set a final litigation schedule, to include a settlement conference.
