TEXT ORDER. On September 22, 2026, the Court requested briefing from the parties to further address their respective positions in writing as to whether this matter should be stayed pending Defendants' 130 appeal.
Defendants' appeal on qualified immunity grounds is not frivolous and trying the non-stayed claim now could generate inefficiencies for the Court and the parties.
For the reasons above and those set forth in Defendants' 136 Letter, the entire action is STAYED pending resolution of Defendants' 130 appeal. See Dkt. 136 . The parties shall file status reports with this Court upon disposition of the appeal. SO ORDERED. Issued by Hon. John L. Sinatra, Jr. on 10/15/2026. (TDM).
