Notice of Voluntary Dismissal - aty
NOTICE of Voluntary Dismissal with Prejudice by Victor Ariza (Hannah, Roderick)
Order Dismissing/Closing Case or Party
PAPERLESS ORDER DISMISSING CASE. THIS CAUSE is before the Court on the Parties' 8 Joint Notice of Settlement, filed December 28, 2022. Therein, the Parties indicate that they have reached a settlement and request twenty days to file dismissal papers. Accordingly, it is ORDERED AND ADJUDGED that this case is DISMISSED without prejudice, all pending motions are DENIED AS MOOT, and this case is now CLOSED. Within twenty days from the date of this Order and upon the filing of a stipulation of dismissal with prejudice or the filing of an appropriate joint motion and a fully-executed Settlement Agreement, the Court may amend this Order to dismiss the above-captioned action with prejudice, to approve the settlement if filed, and/or to retain jurisdiction over the Agreement, if filed. The Parties are advised that the Court does not retain jurisdiction over a settlement agreement without the Parties having filed the settlement agreement with the Court and, absent good cause, the Court does not review proposed settlement agreements for approval in camera. This entry constitutes the PAPERLESS ORDER in its entirety. Signed by Judge Joan A. Lenard on 12/29/2022. (gie)
