REPORT AND RECOMMENDATION: For the reasons set forth in the attached Report and Recommendation, I respectfully recommend that the Court (1) grant default judgment on Plaintiff's federal, New York common law infringement and unfair competition, and New York General Business Law Sections 349 and 350 claims; (2) deny default judgment on Plaintiff's abandoned New York common law dilution and unjust enrichment and New York General Business Law Section 360-L claims; (3) grant Plaintiff's request for a permanent injunction; (4) award Plaintiff statutory damages in the amount of $200,000; and (5) allow Plaintiff to serve restraining notices pursuant to CPLR § 5222 on Defendant and third-party platforms or institutions that hold or manage financial accounts associated with Defendant.
A copy of this Report and Recommendation is being served on Plaintiff via ECF. The Clerk of Court is respectfully directed to mail a copy of this Report and Recommendation to Defendant Sensation Store Corporation at the following address: 2025 Avenue T, Back Office, Brooklyn, NY 11229. Plaintiff is also directed to mail a copy of this Report and Recommendation to Defendant and to file proof of service of mailing by August 31, 2026. Within 14 days of service, any party may serve and file specific written objections to this Report and Recommendation. 28 U.S.C. § 636(b)(1)(C); Fed. R. Civ. P. 72(b). Any requests for an extension of time to file objections shall be directed to Judge Diane Gujarati. If a party fails to object timely to this Report and Recommendation, it waives any right to further judicial review of this decision. See Miller v.
