JUDGMENT OF DISMISSAL by Judge Percy Anderson. IT IS HEREBY ORDERED, ADJUDGED, AND DECREED: Plaintiff's Lanham Act claim is dismissed with prejudice, and judgment is entered in favor of Defendants; The Court declines to exercise supplemental jur isdiction over Plaintiff's remaining state law claims, and those claim are dismissed without prejudice. See 28 U.S.C. 1367(c)(3); and Plaintiff shall take nothing on its Lanham Act claim, and Defendants shall recover their costs of suit. (MD JS-6, Case Terminated). (chk)

MINUTES IN CHAMBERS-COURT ORDER by Judge Percy Anderson. Pursuant to Rule 78 of the Federal Rules of Civil Procedure and Local Rule 7-15, the Court finds this matter appropriate for decision without oral argument. The hearing calendared for December 22, at 1:30 p.m. has been vacated, and the matter taken off calendar. For all of the foregoing reasons, the Court grants Defendants' Motion to Dismiss as to Plaintiff's Lanham Act claim (Claim Four) and dismisses this claim without leave to amend. The Court declines to exercise supplemental jurisdiction over Plaintiff's state law claims (Claims One through Three and Five through Nine) Plaintiff is free to pursue its state law claims in state court. This action is dismissed with prejudice as to Plaintiff's Lanham Act claim, and without prejudice as to all other claims. The Court will issue a Judgment consistent with this order.
