Order on Motion for Settlement
ORDER granting 44 Motion for Settlement Approval: Pursuant to Cheeks v. Freeport Pancake House, Inc., 796 F.3d 199 (2d Cir. 2015), the Motion for Settlement Approval at ECF No. 44, as supplemented by ECF Nos. 46 and 47 is granted. The parties consented to the undersigned magistrate judge's jurisdiction. (ECF Nos. 43 45 .) After reviewing the full record, the Court finds that the agreement "'reflects a reasonable compromise of disputed issues rather than a mere waiver of statutory rights brought about by an employer's overreaching.'" Quispe v. Stone & Tile Inc., 583 F. Supp. 3d 372, 375 (E.D.N.Y. 2022); see also Fisher v. SD Prot. Inc., 948 F.3d 593, 600 (2d Cir. 2020). The Court declines to exercise jurisdiction over any litigation concerning or arising out of the terms of the parties' agreement or the parties' performance of the settlement agreement terms.
The parties' proposed stipulation of dismissal at ECF No. 46-1 is signed only by counsel for Plaintiff. The parties shall submit a fully executed stipulation of dismissal by 05/08/2024. So Ordered by Magistrate Judge Marcia M. Henry on 04/30/2024. (RA)
