ORDER (Consolidating Related Actions; Providing Further Notice of Special Master Appointment) Accordingly, for good cause shown, and since no party objects, the Court exercises its discretion pursuant to Federal Rule of Civil Procedure 42(a)(2) to consolidate these actions. All filings in the Oster matter shall be filed in the MDL going forward. Further, as noted during the status call, the Court intends to appoint retired United States District Judge Mitchell Goldberg as a Special Master to manage and supervise discovery and to act as a mediator pursuant to Rule 53(a)(1)(C) of the Federal Rules of Civil Procedure upon his filing of the required affidavit. The parties will have until September 22, 2026 to file any objections to Judge Goldberg's proposed appointment. Assuming that the Court ultimately appoints Judge Goldberg as Special Master, the Court will require the parties to meet and confer with him no later than December 4, 2026, to set up a proposed discovery schedule that will result in discovery closing no later than the end of June 2027. SEE ORDER FOR DETAILS. It is so ORDERED. Signed by District Judge David J. Novak on 8/27/2026. (jenjones, )
