Status Conference ~Util - Set Deadlines/Hearings
Minute Entry for Status Conference proceedings held on 3/19/2024 before Magistrate Judge James R. Cho: Appearances by pro se plaintiffs Latiff Thompson ("Thompson") and Lawrence Woods ("Woods"); Evan J. Gottstein for defendants.
Before the start of the conference, Matthew Elias ("Elias"), who is currently incarcerated, informed Court staff that he did not intend to participate in the conference. Mr. Elias did not join the conference.
ORDER TO SHOW CAUSE. By 4/19/2024, Mr. Elias is hereby ordered to show cause why he failed to participate in the 3/19/2024 conference, and to advise the Court whether he intends to pursue his claims in this action. Mr. Elias is warned that failure to respond to this order may result in a recommendation to the District Judge that his claims be dismissed for failure to prosecute and for failure to comply with Court Orders.
Mr. Thompson requested an extension of time to file his amended complaint. Mr. Thompson reported that he has an appeal of his underlying conviction pending. The Court grants Mr. Thompson's motion for an extension of time to seek leave to amend the complaint. By 5/20/2024, Mr. Thompson shall move for leave to file an amended complaint; by 6/24/2024, Mr. Woods shall advise the Court whether he joins in the motion to amend the complaint; and by 6/24/2024, defendants shall inform the Court whether they object to Mr. Thompson's motion to amend.
By 4/19/2024, defendants shall file a status report as it relates to any pending appeals by plaintiffs of their underlying criminal cases, and whether this action should be stayed in light of those appeals.
