MINUTE entry before the Honorable Lindsay C. Jenkins. The court has reviewed the parties' initial status report. Both Defendants anticipate a motion as their responsive pleading. In light of the anticipated responsive pleading deadlines (which are slightly different), and to streamline the forthcoming briefs, the court sets the following Rule 12 briefing schedule: any motion to dismiss by any Defendant is due by September 21, 2026; responses are due by October 19, 2026 and any replies are due by November 2, 2026. The August 5, 2026 initial status hearing is stricken and will be reset to a later date. In light of the Monell claim and Defendants' view that that additional discovery (beyond that conducted in the prior state case) could take as many as 9 months to complete, the court is not prepared to stay discovery pending motion practice. Rule 26(a)(1) disclosures are due by August 28, 2026; written discovery shall issue beginning on September 28, 2026.
