ORDER denying without prejudice 59 Motion to Modify the Scheduling Order. On July 31, 2025, the Court entered a scheduling order setting various deadlines, including the completion of discovery deadline for February 27, 2026. ECF No. 29 . On January 30, 2026, the Court granted the parties' request to amend the scheduling order, extending the completion of discovery deadline to August 7, 2026. On August 28, 2026, the parties belatedly submitted an additional request to extend various deadlines -- including deadlines that have already long-since passed -- and an extension of more than six months for completion of discovery. The Court does not find that the parties have established good cause to grant the lengthy extensions the parties propose in their motion. However, in light of the parties' assertion that they agree the matter is ripe for settlement, the Court orders the parties to file a joint status report regarding the status or result of settlement discussions within seven days of the (to be scheduled) settlement conference. If the parties fail to reach settlement, the joint status report shall be accompanied by a proposed amended scheduling order with the completion of discovery deadline set no later than the end of the year.Signed by Judge Sarala V.
