STATUS REPORT by Facet Technology Corp. : The petition for Directors review of the 328 Patent was denied on May 1, 2026. As noted in the previous Status Report, the petitioners in the 255 Patent IPR have appealed the PTABs Final Written Decision to the United States Court of Appeals for the Federal Circuit. Their opening brief was filed on July 27, 2026. Facet has not yet served infringement contentions in this case or defined the set of all asserted claims. See SPR 5.1(a)(1)(A). In its infringement contentions (and/or an amended complaint, if required by the Court), Facet intends to assert at least one of the claims that survived the IPRs of the 255 and 328 Patents. Facet has filed a motion to lift the stay in the matter of Facet Technology Corp. v. Mobileye Global, Inc., Case No. 2:24-cv-00058-RWS, currently pending in the United States District Court for the Eastern District of Texas. Briefing on that motion is now complete. The U.S. Patent and Trademark Offices stay of the ex parte reexamination of the 328 Patent pending the resolution of the 328 Patent IPR remains in place. None of the claims that were found patentable in the 328 Patent IPR are at issue in the ex parte reexamination.(Hanba, Christopher)
