MINUTE entry before the Honorable Jeffrey I Cummings: The Court has reviewed the parties' joint status report and joint stipulation to dismiss and orders as follows. The Court construes plaintiff's notice of voluntary dismissal and unopposed motion to dismiss all claims between plaintiff and defendant R.M. Chin & Associates 36 as a motion for leave to amend and that motion is granted. See Roberts v. Illinois Dep't of Child. & Fam. Servs., No. 4:24-CV-04176-SLD-RLH, 2025 WL 2146832, at *2 (C.D. Ill. July 29, 2025) ("In the Seventh Circuit, Rule 41(a) is limited to dismissing an action, not individual parties... The proper approach to dismissing claims against an individual party is to seek leave to file an amended complaint via Rule 15(a)(2)") (cleaned up). Plaintiff is granted leave to file its amended complaint by 8/7/26 and defendant shall answer or otherwise plead by 8/28/26. The Court adopts the parties' proposed schedule as follows. Any further amendments to pleadings or actions to join other parties shall be filed on or before 10/2/26. Parties shall exchange Rule 26(a)(1) disclosures by 9/11/26 and shall issue initial written discovery requests by no later than 9/25/26. All fact discovery shall be completed by 3/23/27. Plaintiff shall disclose its expert testimony pursuant to Rule 26(a)(2) on or before 4/13/27. The defendant may depose plaintiff's expert disclosed pursuant to Rule 26(a)(2) at any time prior to 5/28/27. The defendant shall disclose any rebuttal expert at any time prior to 5/13/27 and plaintiff shall have until 6/28/27 to depose the defendant's rebuttal expert. Any motions to modify this schedule must be supported by good cause and the party seeking a modification is instructed to meet and confer to attempt to reach agreement prior to filing a motion for a modification. The parties are advised that if at any time they are mutually interested in participating in a settlement conference with the Court, they shall contact this Court's courtroom deputy for a referral to the assigned Magistrate Judge. By 10/7/26, the parties shall file a joint status report setting forth what discovery has been completed, what discovery remains, whether any discovery disputes require the Court's attention, and the status of their settlement negotiations. The previously set 7/20/26 tracking status hearing is stricken and reset to 10/20/26 at 9:00 a.m. (to track the case only, no appearance is required). Mailed notice (cc, ) (Entered: 07/29/2026)
