TEXT ORDER: Plaintiff filed her 1 Complaint on April 14, 2026. Defendant responded with a 6 Motion to Dismiss on August 3, 2026. Plaintiff has now filed a 7 Motion to Amend her complaint. However, this motion is unnecessary. Fed. R. Civ. P. 15(a)(1)(B) says that pleadings "to which a responsive pleading is required"--like complaints--may be amended as a matter of course "21 days after service of a responsive pleading" or 12(b) motion. In other words, Plaintiff's time to amend her complaint will not expire until August 24, 2026 -- 21 days after Defendant served his 12(b) motion to dismiss. Accordingly, Plaintiff's 7 Motion to Amend is GRANTED. Further, Defendant's motion to dismiss the original complaint is moot under Civil Local Rule 7.1(E), as it attacks an inoperative pleading. Therefore, Defendant's 6 Motion to Dismiss is MOOT. Plaintiff's motion to amend also contains a response to Defendant's motion to dismiss. But this response is also unnecessary, as the motion to dismiss is now moot. The Clerk is DIRECTED to docket 7 as Plaintiff's First Amended Complaint. Defendant shall respond to the amended complaint within the time allowed by Rule 15(a)(3). Entered by Magistrate Judge Ronald L. Hanna on August 14, 2026. (BL)
