Order on Motion to Compel
ENDORSED ORDER denying without prejudice for failure to comply with Local Rule 3.01(g) 47 Plaintiffs' motion to compel. Plaintiffs' conferral efforts involved email exchanges between the parties on August 10 and 13, 2026. (Doc. 47 at 3). But as stated in the civil action order: "For anything other than joint or unopposed motions, the term 'confer' requires a substantive conversation in person, by telephone, or via videoconference. It does not envision an exchange of ultimatums by email or letter." (Doc. 14 at 6-7). So, the motion complies with neither Local Rule 3.01(g) nor the civil action order. Plaintiffs may refile a motion to comply that complies with Local Rule 3.01(g) if conferral efforts do not resolve the discovery issue. Signed by Magistrate Judge Nicholas P. Mizell on 8/21/2026. (RCD)
