Order on Motion to Compel
TEXT ORDER regarding 37 and 38 . Defendant stated that its Motion to Compel (DE 38) is moot as the Parties have supplied the requested information. Defendant notes that its Motion to Compel (DE 37) remains pending as to Extreme Hospitality, LLC, and Skyline Asset Management & Consulting, LLC. To permit the Court to resolve Docket Entry 37 on a complete record, Defendant shall, within five (5) days, file a supplemental status report addressing each remaining subpoena recipient separately and: (1) identify any production, objection, communication, or other response received since the applicable motion was filed; (2) state the manner and date of service of the subpoena, identify the person on whom service was made, and identify the basis on which that person was authorized to receive service for the entity; (3) identify the commanded place of compliance and confirm the facts establishing compliance with Federal Rule of Civil Procedure 45(c); (4) confirm compliance with Rule 45(a)(4)'s prior-notice requirement; and (5) file a complete copy of each subpoena as served, including all attachments and document requests. Defendant shall serve its supplemental filing and a copy of this Text Order on each affected subpoena recipient and file proof of service. Any subpoena recipient may file a response limited to the matters addressed above within five (5) days after service of Defendant's supplemental filing. MINUTE ENTRY: The Court held a telephonic status conference pursuant to 48 NOTICE of Telephone Status Conference set for 9/16/2026 to discuss discovery disputes relating to attorney client privilege waiver. The Court directs the attorneys to redouble their efforts in good faith to reach a compromise on the matters discussed on the call, to include resolving any questions relating to the privilege log and the disclosure of privileged communications.
