MINUTE ORDER: This matter is before the Court upon the filing of the 95 Second Amended Collective and Class Action Complaint. "It is well established that an amended complaint ordinarily supersedes the original and renders it of no legal effect." Davis v. TXO Prod. Corp., 929 F.2d 1515, 1517 (10th Cir. 1991). Therefore, any motion to dismiss directed at a superseded pleading is moot. Scott v. Buckner Co., 388 F. Supp. 3d 1320, 1324 (D. Colo. 2019). Here, Plaintiff's 95 Second Amended Complaint and Jury Demand superseded the 51 First Amended Collective and Class Action Complaint, which renders 90 Defendant's Partial Motion to Dismiss Clawges' second Cause of Action directed at the original Complaint moot.
