ORDER (Acknowledging Stipulation of Dismissal and Denying Motions as Moot) - This matter comes before the Court on the parties' Stipulation of Dismissal pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(ii), (ECF No. 39 ). The Court hereby ACKNOWLEDGES this voluntary dismissal with prejudice with each party to bear their own attorneys' fees and costs. The parties agree that pursuant to Kokkonen v. Guardian Life Insurance Co. of America, 511 U.S. 375 (1994), the Stipulation of Dismissal will explicitly reserve jurisdiction in this Court to enforce the terms of the parties' final Settlement Agreement. Furthermore, the Court DENIES AS MOOT Defendants Joseph M Kirchgessner, Woehrle Dahlberg Yao, PLLC's Motion to Strike Plaintiff's Amended Complaint (ECF No. 27 ), Plaintiff Nikola Blagoev's ("Plaintiff") Motion for Judicial Intervention and Relief (ECF No. 31 ), Plaintiff's Motion for Leave to File Second Amended Complaint (ECF No. 38 ), and Plaintiff's Motion to Disqualify Defense Counsel (ECF No. 45 ).
