Order on Motion for Settlement
ORDER: Having reviewed the proposed Settlement Agreement [27-1] and the related submissions, I find, pursuant to Cheeks v. Freeport Pancake House, Inc., 796 F.3d 199 (2d Cir. 2015), that the settlement amount and payment plan are fair and reasonable, that the releases are appropriately limited to wage and hour claims, that there are no confidentiality or non-disparagement provisions, and that the attorneys' fees are reasonable. See Wolinsky v. Scholastic Inc., 900 F. Supp. 2d 332, 335-36 (S.D.N.Y. 2012); Fisher v. SD Protection Inc., 948 F.3d 593, 606-07 (2d Cir. 2020); cf. Lliguichuzhca v. Cinema 60, LLC, 948 F. Supp. 2d 362, 365 (S.D.N.Y. 2013) ("Generally, there is a strong presumption in favor of finding a settlement fair, as the Court is generally not in as good a position as the parties to determine the reasonableness of an FLSA settlement.") (citation and internal quotation marks omitted). Accordingly, the 27 Motion for Settlement Approval is granted and the [27-1] Settlement Agreement is approved. The parties are directed to file a Stipulation of Dismissal or joint status report by August 14, 2026. Ordered by Magistrate Judge Clay H. Kaminsky on 6/26/2026. (TJT)
