USCA Certified Order In Lieu of Formal Mandate (Terminates Appeal)
CERTIFIED ORDER of USCA in lieu of formal MANDATE as to 38 Notice of Appeal, filed by Douglas Bruce, 41 Amended Notice of Appeal (FRAP 4(a)4 Amendment, filed by Douglas Bruce is ruled untimely and insofar as it seeks to challenge the District Court's Rule 11(c)(2) ruling, is premature. For those reasons, we must dismiss this appeal for lack of appellate jurisdiction. We do so without prejudice to Bruce's filing a new, timely notice of appeal after the District Court rules on the City's fee petition. (jw)
