TELEPHONE CONFERENCE held on 9/1/2026 before Judge Philip P Simon. Plaintiffs appeared by atty Scott Seville. Dft appeared by atty Sean Surrisi. Dft summarizes the status of the case from the County's perspective including the State Court proceedings. The parties agree to waive the jury demand and proceed with a bench trial. The Court will address the pending motion for summary judgment and not set a trial date at this time. The Court reminds counsel of the option to consent to the U S Magistrate Judge for trial.
