Order on Motion for Extension of Time to
MINUTE ORDER. The parties reported in September 2023 (via a consent motion filed by Defendants) that they expected to settle this case. See Dkt. 42. Since that time, Defendants have filed four additional unopposed motions requesting extensions of time to respond to Plaintiff's 38 Second Amended Complaint. See Dkts. 44, 45, 46, 47. The Court granted the first three motions; the fourth is currently before the Court.
The Court sees little point in continuing the current cycle of extension motions. In the interest of judicial efficiency, it is hereby ORDERED that this case, including Defendants' obligation to respond to the 38 Second Amended Complaint, is STAYED absent further order of the Court. It is further ORDERED that the parties shall file a joint status report on or before May 31, 2024, and every thirty days thereafter until this case is closed. Notwithstanding the stay, the Court expects the parties to prioritize finalizing their proposed consent order and closing this case. If the parties do not report meaningful progress in doing so in the near future, the Court will lift the stay and require the parties to litigate this case. In light of the stay, it is further ORDERED that Defendants' 47 Unopposed Motion for Extension of Time to Answer or Otherwise Respond to Complaint is DENIED WITHOUT PREJUDICE as moot.
