ORDER: The Clerk of Court is directed NOT to enter a certificate of default at this time. Plaintiff shall file a letter by July 27, 2026 providing an update as to (a) the proper service addresses for the Defendants which Plaintiff seeks a certificate of default and the grounds on which Plaintiff makes that assertion; (b) whether Plaintiff has, in its possession, any contact phone numbers, email addresses, or any other property addresses for those Defendants; and (c) what efforts, if any, Plaintiff has made to determine those Defendants' proper service addresses or contact information, including their email addresses and phone numbers.
By the same date, Plaintiff's counsel shall also address why a certificate of default is sought against Defendant Regions Bank f/k/a EnerBank USA notwithstanding the stipulation of settlement between this Defendant and Plaintiff filed on May 5, 2026 at 30 . Additionally, Plaintiff's counsel shall address whether seeking a default judgment against some but not all defendants in a multi-defendant case would run the risk of inconsistent judgments, and whether the proper course is to postpone the decision on the default judgment until the case against the litigating party concludes. See Lemache v. Tunnel Taxi Mgmt., LLC, 354 F. Supp. 3d 149, 152 (E.D.N.Y. 2019) (citing Frow v. De La Vega, 82 U.S. 552, 554 (1872)); see also Zhao v. Ke Zhang Inc., No. 18-CV-6452 (EK) (VMS), 2025 WL 2774403, at *4 (E.D.N.Y. Aug. 15, 2025) ("Courts in the Second Circuit generally do not enter a default judgment in a case with multiple defendants if the litigation as to one or more defendants is ongoing."), report and recommendation adopted, 2025 WL 2773022 (E.D.N.Y.
