Minute Order. Proceedings held before Judge David Nuffer:
Mr. Turney present for plaintiff. The Court has been instructed that the court is unable to certify to judgment until the 10th Circuit Court Appeals mandate has been received and filed. Mr. Turney addressed the issue. Discussion heard. Mr. Bryson Brown on behalf of Derma Pen LLC made an appearance to address issues raised by the Court. Mr. Turney to prepare authorized certification of the judgment, file new declaration and refer to briefing in the 1126 motion. Mr. Brown to authenticate for the record by filing a declaration with attachments. Court requires a more thorough factual record to resolve the issues before the court. Mr. Brown to provide the court with a proposed order for motion 1126 .
