Minute Order Order on Motion to Withdraw as Attorney
MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Elayna J. Youchah on 10/8/2026. By Law Clerk: C. Yamagiwa.
Before the Court is the Motion to Withdraw as Counsel for Defendant David Kono (ECF No. 212 ). The Motion is denied without prejudice. First, Amanda Brookhyser has never withdrawn as counsel in this matter. A review of the docket shows she is at Brownstein Hyatt Farber Schreck ("BHFS") and is current counsel for Mr. Kono. Given Ms. Brookhyser is no longer associated with Zumpano Patricios Popok & Helsten, PLLC ("Zumpano"), the Court directs Zumpano to file a motion seeking to remove her from the case as counsel for Mr. Kono based on that disassociation. The Motion should explain that Ms. Brookhyser has not represented Mr. Kono since her departure from Zumpano and at no time acted as counsel for Mr. Kono since her employment by BHFS. Second, at no time did Zumpano file a request to remove Ms. Jimenez as counsel in this case based on her disassociation with the firm. Zumpano should do so in the same Motion it files to remove Ms. Brookhyser.
Third, Zumpano's current Motion seeks two forms of relief. It seeks to withdraw as counsel for Mr. Kono (stating he has no objection to the same) and, as his counsel, to extend the deadline for filing the proposed joint pretrial order. Id. at 4. Under Local Rule IC 2-2(b) "[f]or each type of relief requested or purpose of the document, a separate document must be filed and a separate event must be selected for that document." Thus, Zumpano is directed to (1) meet and confer with opposing counsel to discuss whether they will stipulate to an extension of the due date for the proposed joint pretrial order (a proposition the Court supports) and, if so, prepare and promptly, file such stipulation, and (2) file a Motion to Withdraw as counsel that does not include a request for an extension of time on behalf of the client.
Accordingly, IT IS HEREBY ORDERED that Defendant's Motion to Withdraw as Counsel for Defendant David Kono (ECF No. 212 ) is DENIED without prejudice.
IT IS FURTHER ORDERED that Zumpano Patricios Popok & Helsten, PLLC must file a motion to terminate Ms. Brookhyser and Ms. Jimenez as counsel for Mr. Kono based on their disassociation with the firm.
IT IS FURTHER ORDERED that Mr. Helsten must meet and confer with opposing counsel to discuss a stipulation to extend the deadline for the joint pretrial order based on Mr. Kono's need to obtain new counsel. The stipulation, which is favored by the Court, should be filed promptly. If the parties cannot agree on this extension, Zumpano may refile a motion seeking this extension of time.
IT IS FURTHER ORDERED that Zumpano Patricios Popok & Helsten, PLLC must refile a motion to withdraw as counsel for Mr. Kono providing the reasons for the same without discussing the need for a continuance of the due date for the joint pretrial order.
