Initial Conference Hearing ~Util - Set Deadlines
Minute Entry and Order: An Initial Conference was held via video on 8/25/2026 before Magistrate Judge Taryn A. Merkl. Appearances by Joshua Cohen for Plaintiffs; Arthur Sanders for Defendant Zwicker & Associates; Robert L. Arleo for Defendant Mullooly, Jeffrey, Rooney & Flynn LLP; and Richard Boone and Siobhan A. Mueller for Defendant ProVest LLC. Counsel for Defendant ProVest confirmed that they have reviewed the case management statement filed at ECF 26 and indicated that they are contemplating filing a motion to dismiss; Defendant is respectfully reminded that any dispositive motion practice must be initiated in accordance with the individual rules of the assigned District Judge. The Court also reminded the parties of their obligations to preserve and, if appropriate, produce electronically stored information during discovery. The parties' proposed confidentiality order shall be filed on ECF by 9/15/2026.
As stated on the record, the parties' discovery plan is adopted, in part, as follows. Rule 26(a) initial disclosures shall be exchanged by 9/8/2026. First requests for documents and interrogatories shall be exchanged by 9/22/2026. Phase I discovery shall be completed by 10/23/2026. The deadline for joining additional parties and amending the pleadings as of right is 11/20/2026. Fact discovery shall be completed on or before 1/15/2027. The parties are directed to file a joint status report certifying the close of fact discovery by 1/29/2027. In their joint status report certifying the close of fact discovery, the parties are directed to include an update as to whether they need an expert discovery schedule, and if so, shall propose an agreed-upon expert discovery schedule. In the absence of an expert discovery schedule being set, the last date to take the first step in dispositive motion practice is 2/26/2027, and must be done in accordance with the Individual Rules of the assigned District Judge.
The parties are directed to file a joint status report by 11/5/2026, including an update as to their progress on discovery, any settlement discussions, and whether the case should be referred for mediation or a settlement conference before the Court.
