Dems Say NLRB Should Restart McD's Joint Employer Case

Law360 (March 7, 2018, 9:57 PM EST) -- The National Labor Relations Board’s general counsel should move forward with a yearslong case over whether McDonald’s USA LLC and its franchisees are jointly liable for alleged labor law violations, a group of Democratic senators wrote in a letter Wednesday.

The group of lawmakers, led by U.S. Sen. Elizabeth Warren, D-Mass., wrote to NLRB General Counsel Peter B. Robb that the 2015 Browning-Ferris test for determining joint employment is once again the law of the land, now that the board has vacated a more recent decision...
