Judge Trims Subcontractor Suit Over Nuclear Site Cleanup

Law360, New York (December 19, 2012, 7:16 PM EST) -- Portage Inc. convinced a Kentucky federal judge Wednesday to eliminate two claims brought by subcontractor CAF & Associates Inc., but failed to nix claims of fraud and misrepresentation after the energy contractor backed out of an agreement to hire CAF employees to clean up a nuclear site.

U.S. District Judge Thomas B. Russell granted Portage's motions for summary judgment related to CAF's breach of contract and unjust enrichment allegations, while denying a competing motion for summary judgment from CAF.
