Fatal Sex Act Injury Not 'Self-Inflicted'; Insurer Must Pay

Law360 (March 7, 2018, 10:02 PM EST) -- An Illinois federal judge ruled that a man’s death during an act of autoerotic asphyxiation was not a self-inflicted injury and thus an insurer wrongly denied accidental death benefits to his widow.

U.S. District Judge Robert M. Dow Jr.’s Monday ruling sides with plaintiff LeTran Tran, who sued Minnesota Life Insurance Co. seeking payment of accidental death benefits as the beneficiary of her deceased husband’s policy.
