8th Circ. Affirms Insurer Win Over Fire Sprinkler System Costs

Law360, New York (August 11, 2017, 9:02 PM EDT) -- The Eighth Circuit on Friday affirmed the dismissal of a suit by a construction company against Gotham Insurance Co. over coverage for remediating the half-million-dollar mistake of a subcontractor over a misinstalled fire-suppression system.

McShane Construction Co. LLC was an additional insured on the Gotham policy held by subcontractor Mallory Fire Protection Services regarding construction on a $15 million, 196-unit apartment building in Omaha, Nebraska, called the Springs at Legacy Commons.
