ResMed Goes On Warpath Over Sleep Apnea Gear Patents

Law360, New York (March 29, 2013, 6:57 PM EDT) -- ResMed Inc. filed parallel lawsuits in California federal court and the U.S. International Trade Commission on Thursday, targeting Apex Medical Corp. and Medical Depot Inc. over sleep apnea treatment gear that allegedly infringe seven of its patents.

ResMed and two subsidiaries filed an ITC complaint claiming that Taiwan-based Apex and Medical Depot, which does business as Drive Medical Design & Manufacturing, are selling or importing sleep disorder breathing treatment systems that infringe seven patents covering things like respiratory masks and humidifiers.
