Benihana Scores Double Win In Trademark, Libel Suits
By Natalie Rodriguez (July 22, 2014, 6:04 PM EDT) -- Private equity-owned Japanese restaurant chain Benihana Inc. escaped two separate suits Tuesday after a Delaware federal judge agreed to dismiss both Benihana of Tokyo Inc.'s claims that it violated a merger agreement with foreign trademark applications and a defamation suit lodged by the restaurant founder's widow.
U.S. District Judge Sue L. Robinson granted summary judgment in favor of BI, finding that since it rescinded certain international trademark registrations, it did not ultimately breach an agreement that lays out how its supposed to share the Benihana trademark and flower design with BOT.
