Universal Music Can't Register 'As Heard On TV' Trademark

Law360 (April 22, 2019, 4:54 PM EDT) -- The Trademark Trial and Appeal Board is refusing to allow a Universal Music Group unit to register "As Heard On TV" as a trademark, ruling the phrase merely describes a service that offers "TV-friendly music."

In an April 17 decision, the board rejected an application to register a design featuring the phrase that UMG uses as a logo for a library of themes and soundtracks that television and video producers can license for their projects.

Affirming an examiner's decision that the phrase was "merely descriptive" of that service, Judge Thomas Shaw rejected UMG's argument that it was a distinctive double entendre...
