Group's Softball Team Can't Use Batman Logo, USPTO Says

Law360, New York (July 21, 2015, 6:41 PM EDT) -- The U.S. Patent and Trademark Office ruled Friday that a softball team cannot use a lookalike of the Batman logo with the name "Gotham Batmen,” agreeing with DC Comics that its Batman mark is famous and protected by the Trademark Act.

In a July 17 nonprecedential decision, the USPTO found that Gotham City Networking Inc.’s “Gotham Batmen” logo is very similar to DC Comics’ Batman logo, that its goods and services are related and must be presumed to be sold to the same classes of consumers, ruling that it is therefore likely to cause confusion with DC Comics’ marks and batwing...
