2nd Circ. Asks NY Justices To Weigh In On Card Fee Law

Law360, New York (December 6, 2017, 9:58 PM EST) -- The Second Circuit asked the New York Court of Appeals on Wednesday to determine whether a seller who posts the total dollar cost of goods charged to credit card users complies with a New York statute prohibiting sellers from imposing a surcharge related to credit card fees.

The U.S. Supreme Court had remanded back to the Second Circuit the case pitting Expressions Hair Design and similarly situated merchants against New York state, seeking a higher standard of review of New York’s General Business Law § 518...
