Pa. Appeals Panel Backs Hospital Revoking Doc’s Privileges

Law360, New York (December 6, 2017, 3:47 PM EST) -- A Pennsylvania appellate panel ruled Wednesday that a surgeon who performed unauthorized procedures had his hospital privileges properly revoked, saying the hospital’s investigation into the surgeries complied with federal law.

A three-judge panel of the Superior Court of Pennsylvania affirmed a trial court’s ruling granting summary judgment to Somerset Hospital over its surgeon Victor Novak II, finding that it did not conduct a biased investigation into the unauthorized surgeries or damage any of his existing business relationships by revoking his privileges.
