Law360 (November 6, 2018, 2:16 PM EST) -- The U.S. Supreme Court recently denied certiorari in a case arising out of the California state courts that could have enormous consequences for American commerce and industry. My organization, the National Association of Manufacturers, filed an amicus brief calling on the court to take review of the case because its potential ramifications on our sector are broad and extremely concerning. The court's decision to not grant certiorari is an enormous missed opportunity to impose rational limits on what could become an unbounded catch-all tort.
