6th Circ. Won't Hear Appeal Of Darvocet Suit Remand
Law360, Chicago (October 30, 2013, 8:42 PM EDT) -- The Sixth Circuit on Wednesday refused to hear an appeal of a decision remanding to state court one of many suits alleging McKesson Corp. and others didn't properly warn consumers of the risks of painkillers like Darvocet, finding the Class Action Fairness Act issue raised by the defendants has been resolved by another circuit.
In a brief order, the three-judge panel denied a petition to appeal from McKesson and around two dozen other makers and distributors of drugs containing propoxyphene, who had argued the case was a mass action removable to federal court under CAFA.
