Eli Lilly, Others Urge 6th Circ. To Toss Darvocet Appeal

Law360, Los Angeles (November 13, 2013, 6:58 PM EST) -- Eli Lilly & Co. and other drugmakers on Tuesday urged the Sixth Circuit to deny an appeal by plaintiffs seeking to hold them liable for injuries allegedly tied to generic versions of the painkillers Darvocet and Darvon, saying brand-name manufacturers have no legal duty to generics consumers.

In an opposition brief, Eli Lilly, Xanodyne Pharmaceuticals Inc., AAIPharma Inc. and NeoSan Pharmaceuticals Inc. told the appellate court it should affirm a Kentucky district court's rulings granting their motions to dismiss the plaintiffs' claims.
