J&J Unit Accused Of Losing Key Docs In Vaginal Mesh MDL

Law360, New York (December 2, 2013, 8:58 PM EST) -- Johnson & Johnson unit Ethicon Inc. has lost or destroyed at least tens of thousands of documents that could be relevant to ongoing product liability multidistrict litigation over its vaginal mesh implants despite a decadelong litigation hold to preserve such documents, MDL plaintiffs claimed Monday.

In a motion for sanctions filed in West Virginia federal court, MDL plaintiffs claimed that even though a litigation hold had been put in place since 2003, Ethicon's corporate representative James Mittenthal has testified that the firm did not properly implement or monitor this hold and did not sufficiently preserve important information relating the the dispute....
