Safeway Hit With Wrongful Death Suit From Listeria Outbreak

Law360, New York (December 23, 2014, 6:47 PM EST) -- Safeway Inc. was hit with a wrongful death suit Monday in California court, alleging an 87-year-old woman died of a listeria infection after eating a caramel apple purchased at a Safeway grocery store, the first wrongful death suit from the ongoing outbreak.

Plaintiff James Frey said his wife, Shirlee Jean Frey, was a victim of the listeria outbreak that, according to the Centers for Disease Control, has affected 29 people in 10 states as of Dec. 22.
