31 Accutane Suits Tossed After Docs Would Prescribe It Again

Law360, New York (January 29, 2016, 5:41 PM EST) -- Hoffmann-La Roche Ltd. on Friday landed a win in consolidated litigation over claims the company’s acne drug Accutane caused bowel disease, after a New Jersey state judge tossed out 31 cases in which the patient's treating physician said they would have prescribed the drug regardless of an altered warning label.

Granting Roche’s motion for summary judgment in 31 cases, Judge Nelson Johnson found that the drugmaker had met its labeling requirement because the treating physicians in each of those patients’ suit had testified they were aware of possible gastrointestinal risks associated with prescribing Accutane and would not have altered their choice...
