Judicial Review Of A Manafort Pardon Would Be Overreach

By Harold Krent (August 30, 2018, 4:02 PM EDT) -- Last week's conviction of Paul Manafort and plea by Michael Cohen have sparked speculation as to whether President Donald Trump might issue a pardon to his lieutenants and, if so, whether such pardons would be legal. Unlike the circumstances that led to Trump's prior pardons of controversial figures such as Sheriff Joe Arpaio and Dinesh D'Souza, the indictments of both Manafort and Cohen depict a connection between the conduct at issue and that of the president himself. Although the likelihood of a pardon for Cohen seems small given Cohen's expressed willingness to cooperate with special counsel Robert Mueller, Trump's continuing Twitter support for Manafort makes the question of the legality of a possible pardon far from fanciful....
