Calif. City Can Block Medical Pot Dispensary, Court Says

By Jack Queen (January 28, 2021, 7:13 PM EST) -- A medical marijuana dispensary can't undo a California city's injunction blocking it from operating, a state appeals court ruled Thursday, rejecting arguments that a local ordinance barring pot shops was enacted illegally.

A three-judge panel said the city of Montclair showed that its interest in banning dispensaries as a public nuisance outweighed any potential harm to Green Lotus Entertainment Inc., which operated a pot shop under the name Secret Garden. A trial court was therefore free to grant the city's injunction against operating a marijuana business on the property.
