BALCA Affirms Immigrant IT Manager's Labor Cert. Denial

Law360 (April 13, 2018, 7:19 PM EDT) -- The Board of Alien Labor Certification Appeals on Thursday affirmed the denial of labor certification for an immigrant hired as an information technology project manager by Capgemini America Inc., finding that the employer had selectively disclosed the requirements of the position, meaning that it was not clearly open to American workers.
