Law360, New York (June 11, 2015, 11:24 AM EDT) -- A Texas Medical Board rule requiring physicians to conduct an in-person evaluation before they prescribe certain drugs did not go into effect on June 3 as originally planned. A federal court on May 29 granted a preliminary injunction in Teladoc Inc. v. Texas Medical Board to halt enforcement of the rule pending the resolution of an antitrust lawsuit filed by Teladoc, a telehealth services provider. Although the case is being closely watched for its effect on state telehealth laws, its most notable impact may be the future opportunity to test the U.S. Supreme Court's decision in North Carolina State Board of Dental Examiners v. Federal Trade Commission....
