Pa. Judge Urged To Rethink Midtrial Toss Of Risperdal Suit

Law360, Philadelphia (May 3, 2017, 4:32 PM EDT) -- A man who claims a Johnson & Johnson unit's antipsychotic drug Risperdal caused him to grow breasts has asked a Pennsylvania state judge to reconsider his midtrial dismissal of the lawsuit.

Plaintiff Dean Hibbs is trying to revive his lawsuit after Judge Kenneth Powell in the Philadelphia County Court of Common Pleas dismissed the case last month at the request of Janssen Pharmaceuticals Inc., which argued that evidence presented at trial did not show any cognizable link between Hibbs' condition and the Janssen drug. But Hibbs argued in a post-trial brief on Friday that he’d easily cleared his evidentiary hurdle....
